    • Login to 8hoarding.com and Create New campaign in which you will be asked to fill the form which includes Campaign Name, location for advertising, advertising dates and your flexibility with advertising dates and from list of media showed in the next step you can choose media(s) as per your requirements and check out with 10+ payment methods available on the portal.
    • Once we receive order, we send details of your order to our team to get confirmation from the Media owner to create ad space for your advertisement.
    • After receiving confirmation from Media Owner, we confirm your order on the portal and payment is authorized. Incase Media owner has not confirmed availability of media within 48 hours, we cancel the transaction and refund the entire amount to you with 3 to 5 working days.
    • In case the order is confirmed, two days prior to advertising dates, media owner is reminded to mount the media on the hoarding/billboard. Once the process of mounting is done, campaign would commence. Every hoarding mounting process goes thorough scrutiny in order to ensure that media is actually placed on site. For same we ask media owner to upload pictures of mounted media on our portal as well as our validation team also go to site and verify that media is actually mounted.

    • In case of any Damage to Hoarding such as wear & tear, mounting charges are to be paid by the advertiser.
    • In case of any Lighting problems with the Hoarding, we can extend the campaign to the equal number of days in which Hoarding has faced lightning problems.
    • In case of situations like “ACT OF GOD” loss or damage charges will be laid on advertiser.
    • In case of Government involvement on the location of hoarding such as R & B works and Municipal Corporation, extension of campaign is possible for those many days and further, mounting charges are to be paid by advertiser.
    • Advertiser is requested to take insurance for the Hoarding.
    • In case of spelling mistakes and other minor changes on Hoarding, advertiser has to pay the printing charges.
    • If the advertiser uses more than the committed days, advertiser has to pay additional amount for the extra consumed days.
    • In case of any Logo change and any other mistakes, advertiser has to pay the printing and mounting charges for the Modified order.
    • Discounts mentioned in the portal are non-transferable, not for resale, and not redeemable for cash.
    • For payments made through electronic means like debit card, credit card, net banking, wallet etc. refund shall be made using the same payment mode.
    • All advertisers are requested to provide authentic email and contact number as all the communication is done through registered email id and our portal.

    TERMS & CONDITIONS

    • Admybrand is just an aggregator platform and all rights and terms for any order booked on the portal will be carried by the respective Media Owner (Hoardings in this case).
    • Any disputes arise will be solved between respective advertiser and Media owner only, though Admybrand can act as an arbitrator or mediation partner (if all parties agrees for same).
    • The order will be for a total value as mentioned on 8Hoarding for the order period and if the same is not confirmed by within 3 days from booking date then rights to revalidate or renegotiate will be with Admybrand and same can be reflected in your portal.
    • Admybrand shall have the right to re-negotiate / terminate / cease / modify / amend / either in part or in full such terms of order at its sole discretion, for any reason whatsoever.
    • Complete Orders (RO) with cue sheets and all relevant details e.g. photos, location, vinyl etc. filled in must be received by the Admybrand, 7 (seven) days prior to the first date of advertising. Advertiser will ensure to deliver all related materials along with the aforesaid.
    • Confirmed Orders received on portal will be treated as final.
    • Re-schedules will be accepted on portal only if the said request is received on portal by 7 (seven) working days prior of the scheduled published on the spot, and cancellations, if any will require 14 (fourteen) working days notice on portal and by email to [email protected]. Any cancellations raised on portal will ensure “make good” for the same within the same calendar month.
    • The order will be referred exclusively for the purpose of scheduling of spots only other than that no other instructions/ information will be accepted. In case of non-receipt of orders, portal intelligence will be considered for scheduling of spots.
    • All Hoarding are subject to availability and maybe pre-empted as per individual rate card.
    • For impact properties, the advertiser has to consume the committed amount for campaign. No banking of committed days will be allowed.
    • Utilization of Advertising time on a Hoarding has to be completed within the order period. Pattern of utilization of Advertising Time on a Hoarding has to be pre-defined on monthly spread as per the portal and be utilized smoothly within the Order Period. In case of underutilization of the same, the differential shall be billed to the advertiser and the advertiser agrees that the same will be honored.
    • No breaks will be allowed in between order period, unless the Medium have to do so due to unavoidable circumstances.
    • Any request for extension of ad campaign will be entertained and such extension will be executed separately in the portal under “Manage Campaign” section and on the then prevailing rates, availability of slot.
    • In case of excess hoarding ad being consumed, the value of the same will be raised via debit note as per the existing order this is specific to all impact properties, sponsorship etc.
    • Admybrand does not offer any product/category exclusivity. The commercial schedules are subject to change in case of special events etc. Positioning of prints will be at the sole discretion of the Media Owner as per individual rate card.
    • Specials offers will be displayed from time to time and may be dependent on time and channel, these offers can be checked at “offers” section of Admybrand portal.
    • Any cancellations raised in a month for regular booking will attract “make good” for the same & must be issued within the same month.
    • Admybrand will raise bills (in duplicate) on the Advertising Agency/Customer for an Advertiser and arrange to send the same to the Advertising Agency/Customer for onward delivery to the respective Advertiser. Please check “payment receipts” section in the portal.
    • Company will be sending electronic Bills to the Advertising Agency/Customer for the advertisement telecast on the channel through an Email sent to the authorized email ID of the Advertising Agency/Customer/Advertiser as officially communicated at the time of registration on portal. Such Electronic delivery of the bills shall be considered as valid delivery of the bills and would be binding on the Parties.
    • Applicable GST (Goods and Service Tax) & any other tax at the current applicable rate will be paid by the Advertising agency/Customer/advertiser.
    • Bills submitted on portal are to be considered as the final proof of Mounting of Hoarding.
    • Advertising Agency/Customer/Advertiser will ensure that the content/commercial submitted is/are not obscene or blasphemous or defamatory of any event and/or person deceased or alive and will be as per the guidelines Advertising Standards Council of India and such other Indian laws.
    • Advertising Agency/Customer/Advertiser agrees to indemnify and keep safe the Admybrand and respective Media Owner from and against all and/or any claims, costs, and proceedings, by any other person, party, company or organization. Advertising Agency/Customer/Advertiser shall also hold Admybrand and the respective Media Owner harmless against any form of legal proceedings that might for any reason in respect of this Memo deal.
    • Advertising Agency/Customer/Advertiser indemnifies the Media Owner (or Admybrand in case that is made an party in the case) for all amounts in case the Admybrand or respective Media Owner is required to defend the acquired rights in any court of law and such cost of defense would be reimbursed by the Advertising Agency/Customer/Advertiser.
    • The Advertising Agency/Customer/Advertiser agrees to abide by all the rules and regulations, directions, notifications, orders, awards, etc. laid down by any government, semi government, local bodies, authorities etc.
    • Admybrand will be the entity receiving the media booking fee from any third party including advertising brand or an agency for all media bookings made through our respective portal. The revenue share of Media Partner will be only paid by Admybrand on receiving the corresponding payment from the advertiser, subject to revenue sharing terms as included in this agreement. Please note that: In case of non-payment/ partial payment from advertising brand for a campaign, Admybrand will only be liable to pay the sum as is payable from a proportionate basis for all the media of Media Partner which were booked for that campaign.
    • Admybrand reserves the right to modify, update or run promotions on any service at any time. The Supplier (Media Owner) reserves the right to change the price of any service at any time. Once a service has been ordered, the price shall remain fixed for the Customer. Under no circumstances shall the supplier refund the difference should the price of that service decrease. Admybrand can withhold booking amount until the booking period is complete and the advertising brand has paid in full. If the advertiser cancels a booking before payment is made, or if the payment is not cleared by the bank, we are not obligated to pay any amount to the respective parties.
    • Admybrand will transfer up-to half of the booking amount to the Media-Owner on start if campaign and payment will be made on pro-rata basis based on when Ads starts mounting on hoarding and the rest amount of booking amount will be transferred within 15 to 30 days of completion of campaign.
    • All payments will be made against the Bills in Indian Rupees and shall be paid to Admybrand.
    • Admybrand is entitled for certain commission on all the Booking of the Media which are booked during the period of this contract to media-owner established, regardless of point of delivery of the goods. Commission shall be calculated on the net amount of the invoices, i.e. on the effective sales price clear of tax (GST) of any kind, provided that such additional charges, tariffs and taxes are separately stated in the invoice. Admybrand reserves the right to change above mentioned price and payment terms with prior notice to media-owner via verbal or written communication.
    • FORCE MAJETURE: Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.
    • PRICE AND PAYMENT: Payment of the price shall be paid on individual advertising campaigns and by pricing shown on portal. All rates will be for duration of as finalized in portal while booking ads and rates for the spot(s) will be in INR or any other currency (as the case may be). The pricing and deals are non cancelable and non negotiable after booking and once confirmed by respective Media Owner.
    • LIMITATION OF LIABILITY: Admybrand shall not be liable for any direct loss or damage suffered by the Customer howsoever caused, as a result of any negligence, breach of contract or otherwise in excess of the price of the Services. Admybrand shall not be liable under any circumstances to the Customer or any third party for any indirect or consequential loss of profit or other economic loss suffered by the Customer howsoever caused, as a result of any negligence, breach of contract, misrepresentation or otherwise. Admybrand shall not be liable for any non-performance of contract caused by inaction of any third-party entities partner to Supplier and/or Customer or by act of God.
    • SEVERANCE: If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.
    • GOVERNING LAW: These Terms and Conditions shall be governed by and construed in accordance with the law of India. All disputes are subject to jurisdiction of Indore district.
    • DISCLAIMER: Analytics provided for campaigns run on the Platforms are estimations based on the information available by the third parties and are not necessarily claimed to be factually true.
